Description
This presentation discussed the role of health-related arguments in climate change litigation, based on recent evidence discussed in literature and in actual global case law practice. The presentation specifically highlighed several examples of cases in which health-related arguments were well developed, and accepted by courts, and some examples where health-related argumented could have been better presented to argue a succesful human rights claim, or where courts have rejected such arguments. The examples were taken from UN practice, ECHR practice, and several national cases, especially accross the Global South.Period | 16-Jun-2023 |
