Abstract
Within the context of the new Code of Criminal Procedure, the Minister of Safety and Justice suggests (among other) to straighten the 'directing role' of the judge and to extend the possibilities of consensus between the judge and the participatig parties in the proceedings. Development in German law show that this could lead to informal agreements in criminal cases. How do we handle this practice, if it would start to exist here? Other than the suggestions of the Minister, a new reflection on the fundaments of our system is necessary. This contribution provides for a first step in this direction.
