Abstract
Op 30 maart 2022 oordeelde het Gerechtshof Den Haag dat dominee Kort van de Oud Gereformeerde Mieraskerk in Krimpen aan den IJssel niet strafrechtelijk vervolgd hoefde te worden wegens groepsbelediging en het aanzetten tot haat en discriminatie ex artikel 137c en 137d van het Wetboek van Strafrecht. Dat is maar goed ook, wordt in deze Opinie betoogd. Strafbaarheid zou de spankracht van het strafrecht te boven gaan en te weinig recht doen aan de vrijheid van godsdienst en levensovertuiging en die van meningsuiting. Tolerantie is nodig waar het schuurt.
On March 30, 2022, the Court of Appeal of The Hague ruled that Pastor Kort of the Old Reformed Mieraskerk in Krimpen aan den IJssel did not have to face criminal charges for group defamation and incitement to hatred and discrimination ex Article 137c and 137d of the Dutch Penal Code. And that is just as good, it is argued in this Opinion. Criminalization would exceed the power of the criminal law and do too little justice to the freedom of religion and philosophy of life and the freedom of expression. Tolerance is needed where it hurts.
