According to Article 7(2) Brussels I (recast), in matters relating to tort, delict or quasi-delict a person domiciled in a Member State may be sued in the courts of another Member State where the harmful event occurred or may occur. The concept of a harmful event covers both the place where the damage occurred (Erfolgsort) and the place where the event causing the damage occurred (Handlungsort).
This contribution focuses on the location of the damage-causing event. Central to this is the question of what principles the European Court of Justice (CJEU) uses in the interpretation of this concept. By
discussing the case law in a chronological order, it appears to be possible to draw conclusions with regard to the formula used by the CJEU to determine the place where the event causing the damage occurred.
