N1 - Margarita Nieves-Zárate is Lawyer (University Popular of
Cesar, Colombia) and holds a specialisation and LLM on mining, oil and
energy law (University Externado of Colombia). Currently she is PhD
researcher at the Faculty of Law, University of Groningen (Netherlands). Prior
to starting her PhD, she worked as legal advisor for the Colombian National
Hydrocarbons Agency, the Comptroller General of Colombia, the Colombian
Institute of Rural Development, and was appointed by the Colombian
government as secondee to the Energy Charter Secretariat in Brussels. Her
research on energy law focuses on risk regulation in the oil and gas sector, the
promotion of renewable energies in Latin America and climate change.
This article is a revised and expanded version of a paper entitled ‘New modes
of Safety Regulation for Offshore Oil and Gas Exploration and Production in
the United Kingdom and Norway’ presented at the ‘Erasmus Early-Career
Scholars Conference on “New business models and globalized markets:
Rethinking public and private responsibilities”’, Erasmus University
Rotterdam, 12 April 2018, and at the TILT PhD Colloquium ‘Regulating new
technologies in uncertain times’, Tilburg University, 14 June 2018. The author

N2 - This paper analyses how safety regulation evolved in the United Kingdom and Norway from prescriptive regulations to goal-setting regulations in order to manage the risks associated with offshore oil and gas operations. Major accidents in the industry led to reshaping regulatory approaches to rule making, supervising and enforcing safety regulations providing interesting case studies of how law adapts to technological challenges. The allocation of responsibilities between different roles of the regulatory authority, the oil and gas companies and the workforce are important aspects of these new approaches.Keywords: Safety; Offshore; Oil and Gas; exploration and production; prescriptive regulation; goal-setting regulation; supervision.
