The European Succession Regulation and its influence on European land registries

Abstract

Since the entering into force of the EU Succession Regulation, 15 requests for a prejudicial ruling have been submitted to the CJEU on the interpretation of this Regulation. While the Succession Regulation aims to increase the efficiency with which European cross-border successions can be processed, it is argued that it must be carefully balanced against the principle of legal certainty, which forms a cornerstone of European land registration systems. This study takes the perspective of European land registries to analyse whether legal certainty and efficiency are carefully balanced in the judgements rendered by the CJEU.
