Greenforcement through private law: devising environmentally sustainable remedies

It is a striking paradox that the settlement of “Dieselgate”, Volkswagen’s cheating on eco-friendly emissions standards, resulted in environmentally harmful “desert graveyards” of returned cars.
While environmental sustainability is increasingly factored into substantive law, remedial law (which is about enforcing rights and redressing wrongs) appears to disregard sustainability goals. Price reduction fuels further consumption and contract termination regularly involves product destruction. This misalignment weakens sustainability policies.
My new concept ‘greenforcement’ aims at integrating environmental considerations into private law remedies. Focusing on key sectors for sustainability policies: energy, construction, consumer goods, textile and transportation, the project explores whether existing remedies (could) take their potential environmental impact into consideration, and whether new, ‘green’ remedies can be developed.
