The right to energy and the rights to data protection and privacy: towards a coherent enforcement under EU Law within the energy transition

Since the dawn of human history, energy availability has been the lifeblood of human existence and development. Even beyond this, it has been a prerequisite for human dignity. The fundamental role of energy has generated a growing demand for a right to energy. At the same time, extreme dependence on traditional energy sources such as fossil fuels has threatened the environment and climate and, consequently, human life on the planet. This cause-and-effect relationship has sparked a global concern to accelerate the energy transition where digitalisation plays a key role, especially in the EU. This is not just a legal or political issue but an urgent problem that demands immediate action. In this context, concerns regarding the EU's fundamental rights, such as data protection and privacy, have emerged and have been scientifically demonstrated. Such concerns have been sustained over time despite enforcing legally binding European regulations for member states. Two different legal frameworks emerged from this scenario, which still have room for improvement towards a coherent articulation to avoid legal incompatibilities. EU legal instruments on energy transition, data protection, and privacy must be fully compatible to achieve energy and data security. Considering the above context, this paper will determine the historical and legal background of the right to energy. Then, it will analyse the impact of digitalisation on data protection and privacy within the energy transition. Afterwards, EU legal bodies, especially the Recast Electricity Energy Directive and the General Data Protection Regulation, will be analysed to finally develop the following research objectives: to identify the tension points within EU Law regarding the right to energy and the rights to data protection and privacy within an energy transition scenario and to develop recommendations for a coherent legal framework regarding the abovementioned rights. The main result will be identifying the tension points within EU law regarding crosscutting areas between the right to energy and the rights to data protection and privacy, as well as a set of recommendations.
