Samenvatting

The Dutch Supreme Court has answered preliminary questions on civil law sanctions to be applied ex officio in default cases for breaches of information duties under the CRD. The choice for a price reduction pursuant to Article 3:40 (2) of the Dutch Civil Code conflicts with national and European law. Due to the absence of both causation and restitution requirements, the sanction appears at odds with the principle of proportionality.
